Terms of service

In short: VacayMatch compares and refers; it does not sell. Prices include taxes and fees as quoted when checked; the binding price is the one on the booking site. Links are referral links on our own domain; the booking site pays us a fee, your price does not change.

1. Acceptance

These terms govern the VacayMatch website and the VacayMatch WhatsApp service at +1 (276) 300-1021 (together, the "service"), operated by The VacayMatch team ("we", "us"). The service is for residents of the United States aged 18 and over. Sending a message to the service means you accept these terms and the privacy policy. If you do not agree, do not use the service.

2. What the service does

VacayMatch is an AI assistant that helps plan vacations: it searches and compares flights, hotels, packages, things to do and rental cars across booking sites, airlines and hotels, shows options with the all-in price (taxes and mandatory fees included, as quoted when checked), checks which country a hotel is cheapest to book from, and refers you to the booking site to book. On request it also sends reminders, price alerts and tips.

Its replies are information to support your decision, not professional, legal, financial or insurance advice, and it can make mistakes. Verify the essentials (dates, passenger names, cancellation terms, passport and visa rules) on the booking site before you book.

3. Not a travel agency or seller of travel

VacayMatch does not sell travel, does not take payments and does not book on your behalf. It is not a party to any transaction between you and an airline, hotel or booking site. Your contract for the booking is with that supplier, under its terms; booking, payment, tickets, changes, cancellations, refunds and customer service rest with it. Claims about a booking go to the supplier.

4. Prices and availability

  • Every price the service shows is the all-in amount as quoted by the booking site when it checked, taxes and mandatory fees included. If a site adds fees at checkout that were not visible to us, we update as soon as we learn of it.
  • Prices and availability change often. The binding price is the one shown on the booking site at checkout.
  • Currency conversions are approximate; a supplier may charge in another currency at another rate, and your card may add a foreign-transaction fee.
  • We try to cover every site we can reach and do not warrant that a price we found is the lowest in existence.

Links the service sends are short redirect links on our own domain that lead to the booking site. When you book through one, the booking site or its referral network pays us a referral fee. The fee does not change your price. Options are ranked by price and fit to your request only, never by what a site pays, and the cheapest option is shown first even when it pays us nothing. The chat says so wherever links appear, as the Federal Trade Commission's Endorsement Guides ask.

6. Booking from another country

When the service finds that a hotel is cheaper on another country's edition of a booking site, it says so and explains how to book there using a VPN service. Whether to do so is your decision. Check that site's terms, the currency, your card's fees and the cancellation terms before you book, and never claim a residency you do not have. We are not responsible for the booking site or the VPN provider, including price changes, cancelled bookings or charges in another currency.

7. Messages on WhatsApp

The service sends automated messages only after you consent, and only about your own trip: a price alert you asked for, a reminder before you fly, a check on whether you booked, tips before and after landing. Message frequency varies. Reply STOP to end them and HELP for help. Message and data rates from your carrier may apply. Use of WhatsApp is also subject to WhatsApp's own terms.

8. Fair use

The service is for personal vacation planning. Do not use it to collect prices automatically, to harass anyone, to send unlawful content or to infringe others' rights. We may limit or end the service for anyone who breaches these terms.

9. Intellectual property

The name VacayMatch, the mark, logo, design and content of the site and service belong to us or our licensors. Information about flights, hotels and products belongs to the suppliers. Do not copy or use them commercially without written permission.

10. Disclaimers and limitation of liability

The service is provided "as is" and "as available". We do not warrant that it will be uninterrupted or error-free, that prices or availability are accurate, or that it is fit for a particular purpose. To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, including a missed trip or a price that changed, and our total liability to you for all claims relating to the service is capped at $100. Nothing in these terms limits rights that cannot be waived under the law of your state.

11. Dispute resolution

Talk first. If you have a dispute with us, email hello@matchofesh.com with a description of the problem and what you want. We will try to resolve it informally within 30 days.

Arbitration. If we cannot, the dispute will be resolved by binding individual arbitration under the Federal Arbitration Act, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, before one arbitrator. You and we each waive the right to a trial by jury and to take part in a class action or representative proceeding. Either side may instead bring an individual claim in small-claims court.

Opt-out. You can opt out of arbitration by emailing hello@matchofesh.com with the subject "Arbitration opt-out" within 30 days of first using the service. Opting out does not affect any other part of these terms.

Governing law. These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules, until the operating company is formed; from then on, by the laws of its state of formation, which we will name here.

12. Changes to these terms

We may update these terms. A material change will be published on this page and mentioned in the WhatsApp conversation; continued use afterwards means acceptance of the updated terms.
